Employee fired for refusing to work from home during holiday

A man has been awarded 194,000 yuan in compensation after the company fired him for refusing to bring his laptop computer to work from home during the Spring Festival holiday. The company appealed against the decision but was rejected by the court on Monday.
 

The man, surnamed Zhang, who worked at a consulting company in Shanghai as a software engineer, was fired after the Spring Festival of 2019. Zhang's company asked him to take his computer home on the grounds that the customer he was responsible for may require emergency services during the holiday.
 

Zhang rejected the company's order as he wanted to relax and spend the holiday with his family without any work obligations.
 

He was later informed by the company that he had been fired because he "maliciously refused and delayed performing the tasks arranged by the company, and violated the company's working hours regulations," according to the dismissal notice.
 

Shanghai Pudong Court affirmed that the company's termination of its labor contract with Zhang on the grounds of violation of regulations was illegal, and should therefore compensate Zhang for the contract termination, overtime wages and other expenses.
 

程序员拒绝春节加班被开除:判决获赔19.4万

近日,上海一位程序员,因春节拒带工作电脑回家被开除,最终法院判决该公司赔付该程序员共计19.4万元。
 

公司不服已上诉,但最终被驳回了原判。公司称小张春节休了27天假,在这期间拒绝联系、上演“失联”。而被要求加班的小张则认为春节就是放假,为何要让我加班?没有义务工作!
 

被开除后,小张申请劳动仲裁,要求公司支付违法解除劳动合同的赔偿金19.4万元以及加班工资等费用。

最终,小张获赔19.4万元。
