Private clinic operator in Beijing sentenced to 6 months in prison for treating fever patient

A private clinic operator in Beijing who illegally treated a patient with fever which led to a risk of COVID-19 spreading was sentenced to jail for six months for impairing the prevention and treatment of infectious diseases by a court in Beijing on Wednesday.
 

A restaurant worker surnamed Hu who shopped on June 4 at Xinfadi wholesale market in Beijing where the outbreak of COVID-19 occurred last June and July, went to Yujingge clinic operated by the offender surnamed Cui after he had symptoms since June 8.
 

Between June 8 and 10 in 2020, Cui refused to implement the relevant measures for prevention and control of COVID-19 proposed by the disease prevention and control authority in accordance with the laws, illegally received and treated Hu, and failed to report to the health and epidemic prevention department or take other control measures as required in a timely manner.
 

As a result, Hu was not confirmed as infected with COVID-19 or placed under control in time, which caused more close contacts and led to a severe risk of the spreading of the virus. Hu was later confirmed as being infected with COVID-19.
 

Cui was apprehended by police on May 6 this year and charged with impairing the prevention and treatment of the infectious diseases by the procuratorate who suggested a six-month prison sentence.
 

Cui confessed his crime and acknowledged the suggestion of the sentencing. His clinic was revoked on April 23 this year.
 

Beijing City Dongcheng District People's Court gave Cui a lighter punishment of six months in jail in accordance with the laws considering that he truthfully confessed the facts of the crime and voluntarily confessed.

北京一私人诊所违规接诊发热患者,导致感染新型冠状病毒肺炎的胡某未能被及时发现、确诊以及采取控制措施,并进一步密切接触多人,引发新型冠状病毒肺炎传播的严重危险。
 

11月24日,该诊所负责人被北京东城法院以犯妨害传染病防治罪,判处有期徒刑六个月。
 

公诉机关指控,2020年6月8日至10日,崔某在经营其位于北京市东城区永定门外大街的北京御景阁诊所时,拒绝执行疾病预防控制机构依法提出的预防、控制新型冠状病毒肺炎(属于采取甲类传染病预防、控制措施的乙类传染病)疫情的相关措施,违规接诊发热患者胡某,且未按规定及时上报卫生防疫部门或采取其他控制措施,导致感染新型冠状病毒肺炎的胡某未能被及时发现、确诊以及采取控制措施,并进一步密切接触多人,引发新型冠状病毒肺炎传播的严重危险。
 

2021年5月6日,崔某被民警抓获。公诉机关认为,崔某的行为已构成妨害传染病防治罪,建议对其判处有期徒刑六个月。
